The Two Paths: Qualifying vs Non-Qualifying

✓ USMCA-originating goods

  • 0% customs duty
  • No Merchandise Processing Fee
  • Exempt from the forced-labor tariff
  • Requires: valid certification of origin (9 data elements)

✗ Non-originating goods (e.g., transshipped)

  • • Full MFN duty for the true country of origin
  • • Section 301 if China-origin (7.5–25%)
  • • Forced-labor tariff: +10% (12.5% if Chinese origin)
  • • MPF 0.3464% (min $33.58, max $651.50)
  • • HMF 0.125% if arriving by sea
